Two Rules on Medical Disputes Prevention and Management Parallel Implemented

Since October 1st 2018, the Medical Disputes Prevention and Management Rules, reviewed and approved by the State Council meeting, will be put into implementation officially. It is regarded as the first administrative rules focusing on the industrial disputes issued by the State Council. Before formulation, the Rules was widely believed to replace the Medical Malpractice Management Rules that was used to manage the relationship between hospital and patients. The latter one, put into effect in 2002, was controversial for it hardly adapts to demands in new situation. Beyond all expectations, the new Rule and the older one will be effective parallel, but some clauses of the latter one will be no longer applicable.
